Terms of Use

1. Eligibility and acceptance

You must be at least 18 years old and legally capable of entering a binding agreement to use the Directory. If you use it on behalf of a business or organization, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Directory.

2. Purpose of the Directory

The Directory is an informational and community-connection resource. “Verified,” “reviewed,” “dad-approved,” membership labels, featured placement, or similar descriptions generally mean a business or representative has a reviewed connection to the Arizona Dads community. They do not mean Arizona Dads has independently audited or guaranteed the business, its personnel, credentials, services, pricing, availability, conduct, or results.

Our review may rely on information supplied by the business, its representative, community members, public sources, or third parties. Unless we expressly state otherwise in writing, we do not conduct background checks, continuously monitor licenses or insurance, inspect work, investigate every complaint, or independently verify every statement in a listing.

Listings may be incomplete, outdated, inaccurate, suspended, or removed. The Directory is not a marketplace, contracting platform, professional-referral service, or consumer-protection agency. Arizona Dads does not act as the agent, employer, partner, joint venturer, contractor, insurer, licensor, or payment processor of a listed business unless a separate written agreement expressly says otherwise.

3. Your responsibility when choosing a provider

You are solely responsible for investigating and selecting a business, confirming identity and suitability, checking references, licenses, insurance, permits, experience, pricing, scope, schedules, warranties, and contract terms, and determining whether a provider is appropriate for your needs. Any contact, quote, purchase, engagement, or dispute is solely between you and the listed business.

For emergencies, legal, medical, financial, structural, safety-critical, or other regulated matters, use appropriately qualified professionals and emergency services. Do not rely on the Directory as professional advice.

Assumption of risk and release. To the maximum extent permitted by law, you assume all risks arising from contacting, evaluating, hiring, paying, or working with a listed business. You release Arizona Dads LLC and its owners, members, managers, officers, employees, contractors, affiliates, administrators, and agents from claims arising out of or related to your communications, agreements, transactions, disputes, injuries, losses, property damage, or other dealings with a listed business. This release does not waive rights that cannot lawfully be waived.

4. Business listings and submissions

If you submit, claim, update, or manage a listing, you represent and warrant that:

• You are authorized to act for the business and provide the submitted information;
• The information is accurate, current, lawful, and not misleading;
• The business holds licenses, registrations, insurance, permissions, and qualifications required for the services it offers;
• The content does not infringe privacy, publicity, intellectual-property, or other rights; and
• You will promptly request corrections when information changes.

We may review, edit for formatting or clarity, decline, suspend, label, rank, or remove any listing at any time. We are not required to publish a submission or explain an editorial or moderation decision.

5. License to submitted content

You retain ownership of content you submit. You grant Arizona Dads a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, format, adapt, publish, display, distribute, and promote that content as reasonably necessary to operate, market, and improve the Directory and Arizona Dads community offerings. This license lasts while the content is used for those purposes, subject to reasonable backup, archival, legal, and search-engine retention.

6. Acceptable use

You may not:

• Use the Directory unlawfully, deceptively, fraudulently, or to harm or harass another person;
• Submit false reviews, impersonate others, misrepresent affiliation, or manipulate listing placement or referral data;
• Interfere with security, availability, or operation of the Directory, or introduce malware or harmful code;
• Use automated means to scrape, harvest, copy, or create a competing directory from Directory content without our written permission;
• Collect personal information from the Directory for spam, unsolicited marketing, profiling, or resale; or
• Infringe intellectual-property, privacy, publicity, contractual, or other rights.

7. Memberships, featured listings, and azdads.life

The Directory may send you to azdads.life to apply, join, create an account, register for an event, or make a payment. Those activities occur outside the Directory and may be governed by additional terms, privacy notices, refund rules, billing terms, and third-party processor terms presented there. If additional terms conflict with these Terms for a specific paid offering, the additional terms control for that offering.

Paid membership or featured placement may affect visibility but does not guarantee acceptance, continued inclusion, search ranking, traffic, leads, revenue, placement duration, or business results. Membership does not expand the meaning of “verified” or create a warranty to Directory users.

8. Third-party websites and services

The Directory links to websites, social profiles, forms, payment services, and other services controlled by third parties. Arizona Dads does not control or endorse their content, privacy practices, security, availability, products, services, representations, or transactions. A link does not create responsibility for the destination service. You access third-party services at your own risk and should review their terms, policies, credentials, and security practices.

9. Intellectual property

The Directory and its design, text, graphics, branding, software, organization, and other content are owned by or licensed to Arizona Dads and protected by applicable laws. Arizona Dads names, logos, badges, and marks may not be used without prior written permission. Business names, logos, and marks appearing in listings belong to their respective owners.

10. Privacy

Our Privacy Policy explains how we collect, use, and disclose information and is incorporated into these Terms by reference.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DIRECTORY AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ARIZONA DADS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Directory will be uninterrupted, error-free, secure, current, or free of harmful components, or that any listing, business, service, referral, or result will meet your expectations.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIZONA DADS LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, ADMINISTRATORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, PERSONAL INJURY, PROPERTY DAMAGE, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO THE DIRECTORY, A LISTING, A LISTED BUSINESS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE DIRECTORY OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID ARIZONA DADS SPECIFICALLY FOR USE OF THE DIRECTORY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Arizona Dads LLC and its owners, members, managers, officers, employees, contractors, affiliates, administrators, and agents from claims, liabilities, damages, losses, judgments, settlements, and reasonable expenses, including attorneys’ fees, arising from your misuse of the Directory, your submitted content, your business listing, your products or services, your dealings with a Directory user or listed business, your violation of these Terms, or your violation of another person’s rights.

14. Suspension and termination

We may restrict, suspend, or terminate access to the Directory or remove content at any time when we reasonably believe it is necessary to protect the Directory or community, respond to legal or safety concerns, address violations, or discontinue a feature. Sections that by their nature should survive termination will survive, including intellectual-property, disclaimer, liability, indemnity, and dispute provisions.

15. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally for at least 30 days. Unless applicable law requires otherwise, any legal action arising from the Directory or these Terms must be brought in the state or federal courts located in Maricopa County, Arizona, and each party consents to their jurisdiction and venue.

16. Changes to these Terms

We may update these Terms from time to time. The revised Terms become effective when posted unless a later date is stated. Continued use after the effective date means you accept the updated Terms. Material changes may also be communicated through the Directory or another reasonable method.

17. General terms

These Terms and the Privacy Policy are the entire agreement regarding use of the Directory, except for additional terms governing a specific offering. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, transfer, or operation of the Directory. Headings are for convenience only.
